Welcome to Granite City, where our mission is to consistently exceed our guests’ expectations. In order to accomplish this, we collect information to further enhance our level of service. We want to make your experience on our website satisfying and safe, and this Privacy Policy explains our data practices, defines our users’ (“you” or “your”) privacy options, and describes how your information is collected and used by Granite City of America, Inc. (“we,” “us,” “our,” or “Granite City”).
This Privacy Policy and Terms of Use governs your use of the Granite City website at www.gcfb.com/ (“Site”), information provided in the Granite City mobile application, while visiting one of our locations or receiving Services from Granite City and any information we may access through social media platforms such as Facebook, Instagram, LinkedIn or Twitter. For the purposes of this Privacy Policy, we will refer to all of these access points as the Granite City system (“System”).
By using the Granite City System, you agree to the terms of this Privacy Policy and our Terms of Use.
A separate Privacy Policy and User Agreement governs your use of and orders through the website https://gcfb.olo.com/. Granite City mobile application is governed by its own Privacy Policy and End User License Agreement.
REVISIONS TO THE PRIVACY POLICY
We reserve the right to modify this policy from time to time and will mark new versions with a corresponding effective date. We recommend you visit the Site to review any changes in our practices. Your continued use of the System constitutes your agreement to our then-current Privacy Policy.
WHAT INFORMATION IS COLLECTED?
Information Collected Directly from You
This Privacy Policy primarily concerns Personal Information, which deals with individuals, rather than organizations or businesses. “Personal Information” uniquely identifies an individual or can identify an individual by combining it with other data. It includes email addresses, phone numbers and other information associated with the individual. The legal name and definition of personal information differs from jurisdiction to jurisdiction. Granite City will not use or share Personal Information other than as described in this Privacy Policy.
We may collect personal information about you when you, use the System or Site, sign up for a mailing list or our email club or join our rewards program, provide your information in connection with a job application or an inquiry, submit information in connection with a purchase or as part of other online services, register an account, fill out a “Contact Us” form or contact us through our email address or social media pages, post comments, or register for an event.
We may obtain information about you from third-party sources, such as Google, Apple or your employer or insurance provider, when applicable. This information may be utilized, analyzed, and/or compared with information that Granite City has collected from you or that you have submitted to the System. If Granite City obtains information from third-party sources, you agree that your sole legal remedy for any harm associated with that information is against the third-party that provided the information to us, and that you will not assert any cause of action, claim or demand against us other than requesting we delete any erroneous information.
The information we may collect includes, but may not be limited to:
- Name, birth date, and age;
- Email address, phone number, mailing address, and other contact information;
- Your username, password, and other information relevant to register for an account with Granite City;
- Financial information necessary to process a purchase or other request;
- Your employment and educational history and other related information and qualifications;
- your state and county;
- Your responses to customer satisfaction surveys;
- Information you provide to register for any event or program, and/or participate in any event, program, contest, surveys, offers or other promotion that we may offer from time to time, including our Granite City rewards program;
- Business affiliations; and
- Other information related to your requests or inquiries.
For the avoidance of doubt, Granite City shall be entitled to collect anonymous and/or aggregated data across its various products and services provided that no individual natural person can be identified from such data (“Aggregate Data”). The Aggregate Data will be used to analyse behaviour, trends and needs and to improve, and enhance our services and for other development, creation of new features, diagnostic and corrective purposes in connection with our System. Granite City shall own all right, title and interest in and to the Aggregate Data and this is not considered personal data
Information Collected Automatically
Some of the personal information we collect from you may happen automatically. We use tracking technologies such as cookies, log files, and pixel tags to automatically collect information when users visit our System. We may collect and store non-personally identifying information through cookies, and third-parties to profile user activity and preferences. Technical and specification information about your device and settings may be collected when you use the System. This information includes but is not limited to, transaction history, internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, the content of previously accepted “cookies” from us, and clickstream data. We collect and store this information on an individual basis and in combined form. We also collect both user-specific and aggregate information on what pages visitors access or visit.
If you choose to log into your account through our System via social media networking sites, we may collect information provided in your social media account, such as profile information, name, type of mobile device, phone number, email address, profile picture, and friend list. If you do not want us to have access to this information, do not utilize the social media sign-in feature.
Computer data or files, often called “cookies,” which may be sent by your web browser and stored on an individual computer to allow our server to “recognize” you through the navigation of the Site, and for us to credit your account for various online transactions. Cookies allow us to automatically collect information about your activity on the Site, such as the content you access while using the Site, the links you click, and other activity you conduct while using the Site. You may choose to modify your device setting to disable cookies or limit their use. If you choose to disable or limit cookies, or otherwise limit your device permissions to the Site, you may experience diminished performance from the Site and/or may be prevented from using some or all features of the Site. Our cookies generally fall into one of four categories: Essential, Functional, Analytics and Target.
Our System may contain computer data files, often called “web beacons” or “clear gifs” that collect non-personally identifiable information about your us of our System. Such technology may also be contained in emails, newsletters or links on third-party sites that allow our server to evaluate the popularity of those links or the information contained in emails or on third-party sites. The purpose of our use of this technology is so that we may analyze the effectiveness of our marketing efforts and the quality of our System.
Permissions
The following section only applies if you use one of our mobile software applications (the “Software”). The Software requires certain permissions on your mobile device in order to work as intended. You can either allow or deny the Software access to the permissions. In some cases it is necessary for you to grant the Software permissions to take full advantage of features or functionality of the Software. If you disallow some or all permissions, the Software may not function properly. Some of the permissions needed may include access to your device’s: camera; calendar; location; phone; sensor; SMS; and storage. Additional permissions may be requested as new features are added in the future.
COLLECTING INFORMATION FROM CHILDREN UNDER THE AGE OF 13
Our System is not designed for children, and we do not knowingly collect information from any person under the age of 13.
HOW IS THE INFORMATION WE COLLECT USED?
We collect information about you in order to provide you with services and products, and also to collect information that is necessary for the System to work properly. We may use and share your information for any legally permissible purpose. We may match, use, and share any of the information we collect from you to any personally identifiable information we obtain through third-parties. We use personal information for a variety of purposes related to our business, including but not limited to:
- providing you with use of the Site and System and other related services, such as catering services;
- providing you with products or services, whether from Granite City, or any affiliates or sponsors;
- providing you with customized content and services;
- providing technical or customer support;
- performing research and analysis to gauge the use of the Site and System;
- communicating with you by e-mail, push notification, postal mail, telephone, text message, and/or mobile devices about products or services that may be of interest to you from Granite City, any affiliates, sponsors or other third-parties;
- assessing qualifications for employment;
- enforcing, this Privacy Policy, other Granite City posted policies, enforce Granite City agreements, or otherwise manage its business;
- where we have another legitimate interest in doing so;
- in connection with any possible sale merger or restructuring of all or any part of our business or assets;
- compliance with legal obligations; and
- performing functions as otherwise described to you at the time of collection.
DISCLOSURE OF INFORMATION
In order to perform certain services on your behalf, we may publish certain information that you provide. You agree that any testimonial feedback, stories, posts, interactions or other comments provided by you to Granite City through any form of communication including but not limited to through the Site, becomes the sole and exclusive property of Granite City and that such information may be used for any legally permissible purpose, including, but not limited to marketing and advertising our System.
You acknowledge and agree that Granite City may use and disclose your personal and non-personal information to public or private third-parties: (i) for inspection by law enforcement officials (including in the case of potential criminal activity); (ii) to respond to cease and desist letters, arbitration proceedings, legal actions and suits, criminal and civil subpoenas, any court orders; (iii) to enforce or apply the terms of this Privacy Policy or any other agreement between us; and (iv) to protect our, our users, and others’ rights, property, or safety whether during or after the term of your use of our System.
We will not rent or sell personally identifiable information to third parties other than as described in this Privacy Policy.
We will not share your information with third parties to directly market their products to you. We may provide user information to third-party service providers or vendors for purposes including but not limited to:
- Initiating direct marketing programs on our behalf;
- Providing information technology services such as website hosting, computer systems maintenance, or data security and privacy services;
- Data tracking;
- Processing payments and facilitating orders and delivery;
- Maintenance or development of our System;
- Development of online products, services, or customer service, or new product development; and
- Other contracted promotional opportunities provided to our users.
SHARING WITH AFFILIATES.
We may also share this information with any subsidiaries and affiliates. Any local contacts’ website, system, or marketing campaign is governed by the terms of the local contact’s privacy policy and terms of use.
BUSINESS TRANSFERS
We may also disclose your information to a third party as part of reorganization or a sale of the assets of Granite City, or its subsidiaries or divisions. Any third party to which Granite City transfers or sells the System or related assets will have the right to continue to use the personal and other information that you provide to us.
THIRD PARTY WEBSITES AND LINKS
Our System may contain links to other websites. These websites may have privacy policies and terms of service different than our Privacy Policy. The System may also contain certain social media icons or widgets. Although you can view the material we have linked to, you may have to create an individual account or register to use these third-party social media sites to use interactive features. Any interaction on social media or other third-party websites is governed not by this privacy policy but by the terms of use and privacy policy of the particular platform. Granite City cannot guarantee or verify the contents of any externally linked website. You should therefore note you click on external links at your own risk and Granite City cannot be held liable for any damages or implications caused by visiting any external links. We disclaim any and all responsibility for the privacy practices of third-parties that may have links to or from our System.
HOW IS USER INFORMATION PROTECTED?
We maintain administrative, physical, and technical safeguards for all user information collected in our System. Please note, that while we use commercially-reasonable methods to protect your personal information, we cannot guarantee its absolute security. Therefore, although we take reasonable steps to secure your information, we cannot and do not promise or warrant that your information will always remain secure.
ACCESSING, CORRECTING, OR DELETING YOUR INFORMATION
You can review and edit some of your personal information by logging into your rewards account and visiting the “My Account” section. You may also fill out a form at www.gcfb.com/datarequest/ to receive, correct, or delete any personal information that you have provided to us. In certain cases, account information adjustments cannot be made and will require a new account to replace the old information.
We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
If you delete your user contributions from our Sites, copies of your user contributions may remain viewable in cached and archived pages or might have been copied or stored by other users of our Sites.
OPT OUT PROCEDURES
By providing information to us or using our System, you are consenting to our use of your data as outlined in this Privacy Policy.
You may contact Granite City to review, update and correct your Personal Information.
If you do not wish to receive promotional emails or other marketing communications from us, please let us know by using the opt-out response device that can be found at the bottom of every email we deliver or by contacting us as provided below. At places on our Site where you give us your personal information, you may opt out of receiving those communications. Although you can opt not to receive promotional messages, we reserve the right to send you informational email messages about any user account you establish on our Site, or notices regarding the Site, as permitted.
To help us process your request, please include sufficient information for us to identify you in our records. We may need to verify your identity before providing you with personal information or updating it in our System.
YOUR CALIFORNIA PRIVACY RIGHTS
We will not share any personal information about you with other companies if prohibited by applicable California law or to the extent your prior consent to share is required by applicable California law.
If you are a California resident, you may have certain rights with respect to your Personal Information including the following rights:
- the right to know, by way of our Privacy Policy and any specific inquiries you direct to us, where personal information we have about you comes from, what we use that information for, whether it is being disclosed or sole, and to whom it is being disclosed or sold;
- the right to “opt-out” of Granite City sale of your personal information to any third parties;
- the right, with some exceptions, to have your personal information deleted from Granite City possession or control; and
- the right to receive equal service and pricing from Granite City even if you exercise any of your privacy rights.
